Question about a template credit

Hi,

I'd like to use the Something blue template (http://www.webshapes.org/template/details/id/200706015903653630) for one of my website.
I can read that "This design has been provided by Giant Systems Ltd." and "As it would be a helpful way of supporting my work on open source templates I would be grateful if you could leave the lint at the bottom of the page (the one that says "Design by Giant Systems Ltd" in the footer). However the decision is yours, you may remove this if you wish."

This template is very similar to the Beautiful Day template (http://templates.arcsin.se/beautiful-day-website-template), but this one is licensed under a Creative Commons Attribution 2.5 License.

I'm a bit lost... Is the Something Blue template a derivative from the Beautiful Day template, or is it the reverse ? Who should I give credit to then ??

You can remove the link but the License is that you can't resell it and/or claim that it's your copyright version. You can add 'Design by' to the footer if you make some changes visually. Keep in mind that some of the images used by this template may have copyrights too. Just read Creative Commons License information.

It's not your problem, if you use the first one then claim the first one.

You can if you like write them and point out the simularities so they know they may recieve future emails on the subject...

But it is hard to be original these days with code, all web sites use the same elemets so in the long run look alot alike. So unless it is really clear by ID names etc. that it is a copy, it may be just two people thinking alike or one took ideas from the other. Most designers look around and use ideas or concepts that they see on other sites.

Also the question of who created theirs first...

But common license does allow you to take something and change or improve upon it. This is a free template so I do not see anything wrong even if the two are related. You give credit per the template you use.
